From March 10, 2022, temporary protection was introduced in the Republic of Slovenia for persons displaced from Ukraine starting from February 24, 2022 as a result of the military invasion of the Russian armed forces.

What documents are required to enter Slovenia?

Since Ukraine and Slovenia do not have a common land border, citizens of Ukraine are subject to entry requirements established by the respective country whose border is crossed for the first time.

In case of arrival by air transport, citizens of Ukraine must have a valid biometric foreign passport to enter Slovenia. In this case, a separate visa or compliance with any other procedure for entering Slovenia is not required.

For how long can citizens of Ukraine stay in Slovenia?

By default, citizens of Ukraine can stay in Slovenia for 90 days without a special permit. If there is a need to stay in Slovenia longer, you should apply for temporary protection.

Which persons have the right to receive temporary protection in Slovenia?

The following categories of persons who were in Ukraine before February 24, 2022 have the right to receive temporary protection:

– citizen of Ukraine;

– stateless persons and citizens of third countries who are not citizens of Ukraine, who previously had the right to receive international protection or other national protection in Ukraine;

– family members of the above-mentioned persons;

– stateless persons and citizens of third countries who are not citizens of Ukraine, who lived in Ukraine on the basis of a valid permanent residence permit and who cannot safely return to their country or region of origin.

What is the procedure for obtaining temporary protection in Slovenia?

When crossing the border of Slovenia, a person must declare his wish to receive temporary protection. Such a person must submit an application for temporary protection to the police, to which relevant documents are attached.

The application for granting temporary protection is sent by the police to the administration of the relevant district (at the applicant’s place of residence).

Persons who illegally entered Slovenia after February 24, 2022 (the application is submitted within 3 days from the moment of entry), as well as persons who were in the Republic of Slovenia as of February 24, must also submit an application for temporary protection in 2022. Such applications are also sent by the police to the administration of the district in which the applicant is located.

Citizens of Ukraine and other persons are exempted from paying the duty for submitting an application for temporary protection.

What is the procedure for considering an application for temporary protection?

The administration of the relevant district of the applicant’s settlement in a shortened procedure examines the submitted application and determines whether the citizen of Ukraine is subject to the conditions for granting temporary protection.

In case of a positive decision, the administration issues the applicant an identification card, which is also valid as a temporary residence permit in the Republic of Slovenia for the duration of the temporary protection.

What is the validity period of temporary protection in Slovenia?

The duration of temporary protection is 1 year from the moment of the administration’s decision. This term can be extended, but not more than 2 times for 6 months.

In some cases, temporary protection may be suspended or revoked (in particular, in case of submission of inaccurate information or documents).

After the termination of temporary protection, the general provisions of Slovenian legislation on foreigners apply to citizens of Ukraine.

What rights do citizens of Ukraine have in Slovenia during the temporary protection regime?

Citizens of Ukraine and other persons granted temporary protection in Slovenia have the right to accommodation and meals in accommodation centers or financial assistance for private housing, medical assistance, access to the labor market, education, financial assistance or pocket money, family reunification free legal assistance.

Is there an obligation for citizens of Ukraine to notify their address of residence in Slovenia?

Citizens of Ukraine are obliged to report their address of residence within 3 working days from the moment of entry to the relevant police department.

In the case of accommodation in an accommodation facility (hotel, dormitory), the duty of notification rests with the owner of such facility.
