Regulatory framework
In Ukraine, responsibility for not being registered with the military commissariat is regulated by a number of legislative acts. Such acts include the Constitution of Ukraine, the Criminal Code of Ukraine, the Code of Ukraine on Administrative Offenses, the Law of Ukraine “On Military Duty and Military Service”, Decree of the Cabinet of Ministers of Ukraine dated December 30, 2022 No. 1487 “On Approval of the Order of Organization and Maintenance of Military Records” conscripts, conscripts and reservists” and Order of the Ministry of Defense of Ukraine dated October 11, 2021 No. 313 “On approval of the List of specialties and/or professions related to the relevant military accounting specialties, after receiving which women are accepted for military registration of conscripts and List of specialties and/or professions related to the relevant military accounting specialties”.
Military duty
Military duty is one of the main mandatory requirements of the state for its citizens. This means that every citizen of Ukraine must undergo military service or alternative (non-military) service, if it is provided for by law. Military duty is established by the Law of Ukraine “On Military Duty and Military Service”, which regulates the procedure for enlisting citizens for military service, ensuring their acceptance into military registration, keeping military records and other issues related to military duty.
Registration to conscription stations
Registration at conscription stations is mandatory for all citizens of Ukraine who have reached the age of 18. This means that every citizen who has reached the age of conscription must go to the military commissariat, where he will be given documents for medical examination and conscription for military service or alternative (non-military) service.
Military accounting
Military registration is an important stage in ensuring the fulfillment of military duty by citizens. Military registration is carried out by the military commissariat, which maintains the personal file of each conscript citizen, which includes information about his registration, medical examination, draft for military service, as well as alternative (non-military) service.
Administrative responsibility
Violation of military accounting requirements is subject to administrative liability in accordance with the Code of Ukraine on Administrative Offenses. For example, if a citizen has not applied to the military commissariat to be registered at the conscription station, he may be held administratively liable, which involves a fine of 10 to 20 of the tax-free minimum income of citizens.
Criminal responsibility
Criminal liability is provided for more serious violations of military registration, for example, for evasion of the draft or failure to return from military service after its completion. Criminal liability is stipulated by the Criminal Code of Ukraine and may include imprisonment for up to 5 years.
Legal, economic, cultural features of Ukrainians
Ukrainians have their own characteristics that affect their performance of military duty and resp
notification for not registering at the military commissariat. For example, national and cultural characteristics can affect the attitude to military service, and the economic situation in the country can force some citizens to evade military duty.
Responsibility for not registering at the military commissariat during the war in Ukraine
During the war in Ukraine, the responsibility for not being registered at the military commissariat is special. According to the Resolution of the Cabinet of Ministers of Ukraine dated December 30, 2022 No. 1487 “On approval of the Procedure for the organization and maintenance of military records of conscripts, conscripts and reservists”, in the event that citizens who are subject to conscription are not registered at the military commissariat, they may be summoned to military service without further notice.
At the same time, the responsibility for not being registered with the military commissariat can be increased, because during the war, the performance of military duty is especially important for ensuring the security of the state and protecting its territorial integrity.
Conclusion
Therefore, if you are a citizen of Ukraine and do not have a corresponding record at the military commissariat, we recommend that you contact the military commissariat and take part in the registration at the conscription station.
This will help you avoid trouble and liability for not registering at the military commissariat. Also, if you have special abilities or qualifications in a certain field, then pay attention to the List of specialties and/or professions related to the relevant military accounting specialties, after receiving which women are taken to the military accounting of conscripts. Order No. 313 of the Ministry of Defense of Ukraine dated October 11, 2021 approved this list and indicated the conditions and procedure for accepting women into military service.
